Terms of Service

1. Who we are

Drill is operated by Jordan Martinelli, a French sole proprietor (auto-entrepreneur), SIREN 849 052 915, at 17 Imp du 11 Novembre, 06400 Cannes, France. Contact: legal@getdrill.app.

By creating an account or using Drill, you agree to these Terms.

2. The service

Drill is a learning tool that helps students verify what they actually know using spaced repetition and short study protocols. We may change, add, or remove features to improve the product.

3. Eligibility

You must be at least 13 years old to use Drill. If you are between 13 and 16, you need parental or guardian consent. If you use Drill on behalf of an organization, you confirm you have authority to bind it to these Terms.

4. Your account

You are responsible for keeping your credentials secure and for any activity under your account. Notify us immediately if you suspect unauthorized access.

5. Subscriptions and billing

  • Paid plans are billed via Stripe on a recurring basis until cancelled.
  • You can cancel at any time from your account; access continues until the end of the paid period.
  • Prices may change; we will notify you before the change applies to you.
  • Refunds are handled case-by-case, in line with applicable consumer law.

6. Acceptable use

You agree not to:

  • Break the law or infringe others’ rights.
  • Upload content that is illegal, harmful, hateful, or violates intellectual property.
  • Scrape, reverse-engineer, or abuse the service or its APIs.
  • Resell, sublicense, or redistribute Drill without written permission.
  • Attempt to disrupt or compromise the service or its users.

7. Your content

You keep ownership of the content you create in Drill (decks, cards, notes). You grant us a limited license to host, display, and process that content strictly to operate the service for you. We do not use your content to train AI models.

8. Our content

Drill, its brand, logo, design, code, and all original materials are owned by us and protected by intellectual property laws. These Terms do not transfer any rights in them to you.

9. Third-party integrations

Drill may integrate with third-party services (e.g. AI assistants via our MCP server). Your use of those services is governed by their own terms. We are not responsible for third-party services.

10. Termination

You can delete your account at any time. We may suspend or terminate access if you violate these Terms, create legal risk for us, or abuse the service. On termination, your right to use Drill ends; data is handled per our Privacy Policy.

11. Warranty disclaimer

Drill is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability.

12. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to Drill is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be excluded by law (including mandatory French consumer protections).

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email or an in-product notice. Continued use after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by French law. Disputes fall under the jurisdiction of the competent French courts, subject to any mandatory consumer rights that allow you to bring a claim in your country of residence.
